Meme Envy Terms of Use

1. Acceptance of Terms

By accessing or using the Meme Envy app (“the App”), you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use the App. Meme Envy reserves the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on the App. Your continued use of the App following any modifications constitutes your acceptance of the modified Terms.

2. Use of the App

Meme Envy is an interactive platform where users can create, share, and compete with memes. You agree to use the App at your own risk. Meme Envy is not responsible for the content you create, share, or interact with on the App.

3. User-Generated Content

You are solely responsible for the content you create, upload, post, or share on Meme Envy (“User-Generated Content”). By submitting User-Generated Content, you represent and warrant that: – You own or have the necessary rights to the content. – The content does not infringe upon any third-party rights, including intellectual property rights. – The content complies with all applicable laws and regulations.   Meme Envy does not pre-screen or endorse any User-Generated Content and is not responsible for the actions or content of users. You agree that you may be exposed to content that is inaccurate, objectionable, or offensive, and you use the App at your own risk.

4. Content and Conduct Restrictions

You agree not to use the App to: – Post or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. – Violate any applicable local, state, national, or international laws. – Infringe upon the rights of others, including intellectual property rights. – Engage in any conduct that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.

5. Intellectual Property

Meme Envy and its licensors retain all rights, title, and interest in and to the App, including all related intellectual property rights. These Terms do not grant you any rights to use the Meme Envy name, logos, trademarks, or any other intellectual property, except as expressly permitted by these Terms.

6. Limitation of Liability

To the fullest extent permitted by law, Meme Envy, its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: – Your access to or use of or inability to access or use the App. – Any conduct or content of any third party on the App. – Any content obtained from the App. – Unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to indemnify, defend, and hold harmless Meme Envy and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: – Your use or misuse of the App. – Your violation of these Terms. – Your violation of any rights of another, including intellectual property rights. – Your User-Generated Content.

8. Disclaimer of Warranties

Meme Envy provides the App on an “as is” and “as available” basis without any warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title. Meme Envy does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Meme Envy is based, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes arising from or related to these Terms or your use of the App.

10. Termination

Meme Envy reserves the right to terminate or suspend your account and access to the App at its sole discretion, without notice, for conduct that Meme Envy believes violates these Terms or is harmful to other users, Meme Envy, or third parties.

11. Entire Agreement

These Terms constitute the entire agreement between you and Meme Envy regarding your use of the App and supersede any prior agreements between you and Meme Envy.
